This policy defines the scope of privacy applicable to information provided by users during registration at and normal use of Klatz (“Site”), and Klatz’ services and programs. At any time, users can, at their discretion, allow or forbid the collection and use of their personal information.
This policy applies to Site, owned and operated by Depositphotos Inc., a Delaware corporation (3500 South DuPont Highway, Dover, Kent county, DE 19901, file number 5777563), and its affiliates (collectively, “Klatz”). By using the Site, the user provides his/her consent that Klatz has the authority to collect, use and disclose the user’s personal information according to this policy.
Klatz proclaims and accepts its responsibility to protect the user’s personal information. This policy contains the rules upon which such information is collected and used, and also the reasons for the disclosure of such information.
During the work with Site, technical non-personal information about the user – such as the user’s IP address, the address of another site the user came to the Site from, the time of the visit, the browser type and language – may be collected automatically. We may also collect and analyze navigational information, namely the address and path of the user through the Site, actions performed at the Site, jumps to and from inner links, etc.
Personal information about the user is collected only upon obtaining prior permission from the user to collect and use certain information within these rules. Giving such permission, the user supplies such information voluntarily.
"Personal information" includes:
information supplied by user during registration at the Site, including login, full name and email. Klatz may also collect additional information such as postal address and contact phone number where necessary;
information supplied by user during purchase, such as a billing address and card number;
for certain categories of users, information provided by them for payments, including data about the account in a financial institution used for the payments, and also information supplied by the user for personal identification (copy of the passport, driver’s license or other personal identification document).
Registered users also have the option to provide additional personal information such as address and phone number in their profiles. Each user can control what information is displayed publicly.
Klatz never requires users to provide genetic data, biometric data, information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, or data concerning their health, sex life or sexual orientation.
Each user may refuse to submit personal information at any time. However, in certain cases, some functions and services offered at the Site may be diminished and/or made unavailable, in part or in their entirety.
Collection and use of the user’s personal information is performed by Klatz for the following purposes:
creation, management and maintenance of accounts;
processing of users’ inquiries and operations at the Site;
data analysis and statistical research for the purposes of improving offered goods, products or technologies;
provision and display of the content specially chosen in accordance with preferences and interests of the user;
maintenance and operation of interactive areas;
payments to users;
identification of content as belonging to a certain user;
communication about transactions made by users;
notification about new goods and services;
marketing communications for promotion and advertising of Klatz’ and third-party products.
Klatz will ask for a user’s consent before using his/her personal information for a purpose other than those listed in this policy.
Klatz collects personal information only about its users and does not require them to provide Klatz with personal information about any third parties.
Klatz may send users communications concerning transactions they performed, payment reminders and questions concerning purchase confirmation.
Users are free to select a one-click opt-out to unsubscribe from promotional and advertising communications; Klatz will no longer send promotional and advertising messages once such a request is received from a user. This one-click option is not available for transactional messages that are generally required. In order to opt out of communications connected to transactions, users would have to deactivate their accounts.
Our promotional and advertising messages will always be clearly identified as promotional and/or advertising and will always contain both the return email address and the physical postal address of Klatz. This return email address will be capable of receiving user communications for not less than 30 days after the transmission of the original message.
Personal information collected by Klatz may be processed and stored in other countries at facilities belonging to Klatz and/or legally used by Klatz. By supplying Klatz with their personal information, users permit its transfer outside the country within the bounds of such use, notwithstanding that privacy laws in other countries where the information is transferred may not provide as much protection as those in the users’ jurisdiction.
Except in cases clearly stated in these rules, Klatz does not disclose, sell, lease, lend, rent or make available personal information of its users to any third parties.
Users’ personal information can be disclosed and shared with partner agencies that render services on behalf of Klatz. The services may include money transfer, data storage, reselling licenses, payment processing, etc. These third parties will receive only the information required to provide said specific services; the information will be kept and protected by the same principles and level of protection as followed by Klatz, and it cannot be used for any other purposes.
Information about its users may also be passed and disclosed as a business asset in the case of acquisition, sale or absorption of the company.
Klatz reserves the right to disclose and pass personal information about a user if it is required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our Site.
Information submitted by users can be reviewed and edited in the section "For Clients". Alternatively, users may contact Klatz at email@example.com and request a copy of the information collected by Klatz, extracted and provided in a readable format. Klatz will respond to such requests without unreasonable delay.
We will retain users’ information for as long as their accounts are active or as needed to provide services to users.
Users may contact us at firstname.lastname@example.org in order to cancel their account or request that we delete or no longer use their information to provide services. After receiving such a request from a user, we will retain and use the user’s information only to the extent necessary to comply with our legal obligations, prevention of fraud, resolution of disputes and the performance of our agreements.
Users can allow or forbid the use and acceptance of cookies on their computer. If cookies are blocked by a user, that user may be prevented from registering or performing other interactive functions of the Site, but it will not affect the user’s ability to perform general navigation within the Site.
Email information collected for sending lightboxes is not stored or used for any other purpose. That information is not shared with any other parties.
Klatz actively monitors and enforces its information protection standards during all Klatz activity, namely:
limitation of access to user information only to those employees who need it to provide services to users;
execution of confidentiality agreements by employees;
execution of confidentiality agreements by partners and external companies invited to perform particular functions, specifying that they not use such information for any unauthorized purposes;
encryption of payment data, such as card numbers, using SSL technology through the use of third-party payment gateway service providers;
storage of the personal information obtained from users in encrypted form, at protected computers secured from unauthorized access.
Since there is no perfectly secure method of protecting information while it is stored, processed and transferred in its electronic form, Klatz cannot fully warrant its complete safety, despite all efforts made by the company. Since the information in an account and the personal data of a user are protected with a password, the safety and nondisclosure of this password are the responsibility of the user him- or herself.
Users also have a right to lodge a complaint with competent supervisory authorities in countries of their residence or location, should the users believe that any of their privacy rights have been infringed by Klatz.
The Site, its content and services are neither intended to be used by minors and persons under the age of 18, nor designed and intended to willfully and knowingly collect, use, or disclose any personal information from minors and persons under the age of 18. Klatz will immediately remove personal information about children and/or search to obtain a verifiable parental consent for the collection, use, or disclosure of personal information from children, once it comes to Klatz’ attention that any personal information from children was submitted or collected through the Site.
Users confirm and warrant that they have reached the age of 18, have all the qualifications for using the Site and are bound by legal obligations sufficient for any liability that can arise as a result of using the Site files. Users agree to bear full responsibility for all occasions of Site usage, without distinction, as well as for the use of his/her login and password by third parties including minors and persons under the age of 18 living with him/her.
The Site pages can contain links to sites, services and functions of third parties, subsidiaries and affiliates that may use and conform to rules and procedures different from the confidentiality provisions stated here. Klatz is not responsible for the confidentiality policyies and practices of such entities.
The Site may offer publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at email@example.com
The Site includes Social Media Features, such as the Facebook “Like” button, and Widgets, such as the “Share This” button, or interactive mini programs that run on our Site. These Features may collect your internet protocol address and which page(s) you visit on our Site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy statement of the company providing them.
Both users and persons who don’t use Klatz services shall be free to contact Klatz with any questions, concerns or suggestions regarding our privacy.
